What changed in December 2025

One rule went away. The harder one stayed.

In December 2025, CMS repealed the federal minimum staffing numbers. The HPRD floor and the 24/7 on-site RN requirement are gone. But the Facility Assessment requirement under 42 CFR 483.71 and F838 survived the repeal and remains in full effect.

With no federal number to point to, your facility assessment is now the primary document CMS uses to hold you accountable for staffing to resident acuity.
